Notice of release of student information

The Muroc Joint Unified School District was recently notified of the California Department of Education's intention to disclose student records to the United States District Court in a pending lawsuit known as the "Morgan Hill" case.

The information released, including personally identifiable information, is being disclosed subject to a court-issued protective order. None of the information used in the lawsuit will be used outside of the court and the involved parties are required to return or destroy the records at the close of the lawsuit.

The notice applies to the parents or guardian of any student who is, or was attending, a California school at any time since January 1, 2008. It also includes any person over the age of eighteen who attended a California school at any time since that date.

If any affected individual is opposed to the disclosure of a student's information and records, they must notify the court by April 1, 2016. This can be done by completing the "Objection to Disclosure of Student Information and Records Case No. 2:11-CV-03471" form at the CDE's website www.cde.ca.gov/morganhillcase. This can also be done by sending a confidential letter to the judge.

The Morgan Hill case will investigate whether the CDE violated the Individuals with Disabilities Education Act (IDEA) as alleged by the Morgan Hill Concerned Parents Association and Concerned Parents Association. The CDE has denied the allegations including accusations that they failed to monitor, investigate, provide services to and enforce the rights of children with disabilities.

Muroc Joint Unified School District will not be releasing any student records, but does urge parents to consider the matter carefully before the deadline of April 1.
