Second quarter military justice actions

Nonjudicial punishment is a tool that provides commanders with an essential and swift means of maintaining good order and discipline. It also promotes behavior changes in servicemembers without the stigma of a court-martial conviction.

A suspension is the postponement of the application of all or part of the punishment for a specific probationary period. The punishment will be automatically remitted at the end of that period, if the member does not violate the conditions of his or her suspension or any other article of the Uniform Code of Military Justice.

The following Article 15s were processed at Edwards during the second quarter of 2012.

- A captain committed an assault in violation of Article 128, UCMJ, destroyed non-military property, in violation of Article 109, UCMJ, and demonstrated conduct unbecoming an officer, in violation of Article 133, UCMJ. The commander imposed the following punishment: Forfeiture of $2768.00 pay for one month and a reprimand.

- A staff sergeant committed an assault consummated by a battery, in violation of Article 128, UCMJ. The commander imposed the following punishment: Reduction to the grade of Senior Airman, suspended forfeiture of $1,181.00 pay per month for 2 months, and a reprimand.

- An airman first class failed to go to his duty location in violation of Article 86, UCMJ. The commander imposed the following punishment: Reduction to the grade of Airman, suspended forfeiture of $835.00 pay per month for 2 months, 15 days extra duty and a reprimand.

- An airman first class wrongfully used marijuana in violation of Article 112(a), UCMJ. The commander imposed the following punishment: Reduction to the grade of Airman Basic, suspended forfeiture of $745.00 pay per month for 2 months, and a reprimand.

- A senior airman was cited for reckless driving in violation of Article 111, UCMJ . The commander imposed the following punishment: Suspended reduction to the grade of Airman Basic, 45 days extra duty and a reprimand.

- An airman first class failed to obey a lawful order in violation of Article 92, UCMJ, gave a false official statement in violation of Article 107, UCMJ, and damaged government property in violation of Article 108. The commander imposed the following punishment: Suspended reduction to the grade of Airman Basic, 45 days extra duty and a reprimand.

- An airman first class committed larceny in violation of Article 121. The commander imposed the following punishment: Reduction to the grade of Airman first class, 45 days restriction to Edwards Air Force Base and a reprimand.

- A staff sergeant was derelict in the performance of his duties in violation of Article 92, UCMJ. The commander imposed the following punishment: Reduction to the grade of Senior Airman and a reprimand.

- An airman first class was drunk and disorderly in violation of Article 134, UCMJ. The commander imposed the following punishment: Suspended reduction to the grade of Airman Basic, 45 days extra duty and a reprimand.

- A staff sergeant wrongfully used a controlled substance, steroids, in violation of Article 112(a), UCMJ. The commander imposed the following punishment: Reduction to the grade of Senior Airman and a reprimand.
