Third quarter military justice actions

The following Article 15s were processed at Edwards during the third quarter of 2012.

Nonjudicial punishment (Article 15) is a tool that provides commanders with an essential and swift means of maintaining good order and discipline. It also promotes behavior changes in service members without the stigma of a court-martial conviction.

- An airman first class was cited for Reckless Driving and being Absent Without Leave, in violation of Article 111 and Article 86, Uniform Code of Military Justice. The commander imposed the following punishment: reduction to grade of airman basic, suspended forfeiture of $745 pay for two months, 30 days extra duty, and a reprimand.

- A lieutenant colonel operated a passenger car while intoxicated and was drunk on duty, in violation of Articles 111 and 112, UCMJ. The commander imposed the following punishment: forfeiture of $800 pay per month for two months, and a reprimand.

- A staff sergeant failed to maintain positive control of his weapon, a negligent dereliction of his duties, in violation of Article 92, UCMJ. The commander imposed the following punishment: suspended reduction to the grade of senior airman, forfeiture of $1,181 pay, and a reprimand.

- A senior airman was driving while intoxicated in violation of Article 111, UCMJ. The commander imposed the following punishment: reduction to the grade of airman first class, suspended forfeiture of $990 pay per month for two months, and a reprimand.

- A master sergeant committed a false official statement, in violation of Article 107, UCMJ by changing the scores on his fitness assessment scorecard. The commander imposed the following punishment: reduction to the grade of technical sergeant, suspended forfeiture of $225 pay per month for two month, and a reprimand.

- A senior airman wrongfully used marijuana in violation of Article 112(a), UCMJ . The commander imposed the following punishment: reduction to the grade of Airman Basic, 30 days restriction to Edwards Air Force Base, 45 days extra duty, and a reprimand.

- A senior airman committed larceny in violation of Article 121, UCMJ. The commander imposed the following punishment: reduction to the grade of Airman First Class, forfeiture of $250 pay per month for one month, suspended 30 days extra duty, and a reprimand.

- A technical sergeant failed to pay his Government Travel Card debts in violation of Article 92, UCMJ. The commander imposed the following punishment: suspended reduction to the grade of Staff Sergeant, 45 days extra duty, and a reprimand.

- A senior airman did not report for work, gave a false official statement and misused a government travel card, in violation of Articles 86, 92, and 107, UCMJ. The commander imposed the following punishment: reduction to the grade of airman first class, suspended 30 days extra duty, and a reprimand.

- A senior airman committed adultery, in violation of Article 134, and interfered with an administrative proceeding by intimidating witnesses, in violation of Article 134, UCMJ. The commander imposed the following punishment: 45 days extra duty and a reprimand.

- An airman first class was derelict in the performance of his duties in violation of Article 92 and made two false official statements in violation of Article 107, UCMJ. The commander imposed the following punishment: suspended reduction to the grade of Airman, forfeiture of $417 pay per month for 2 months, 30 days extra duty, and a reprimand.

- A staff sergeant committed an assault and communicated a threat in violation of Articles 128 and 134, UCMJ. The commander imposed the following punishment: suspended reduction to the grade of senior airman, forfeiture of $250 pay per month for two months, 14 days extra duty, and a reprimand.

- A staff sergeant failed to pay his debts, in violation of Article 134, UCMJ. The commander imposed the following punishment: suspended forfeiture of $750 pay per month for two months, suspended 30 days extra duty, and a reprimand.

- A technical sergeant committed a willful dereliction of duty by having an unprofessional relationship with a recruit, in violation of Article 92, UCMJ. The commander imposed the following punishment: reduction to the grade of staff sergeant, and a reprimand.

- A staff sergeant committed a willful dereliction of duty by failing to refrain from sleeping on duty, in violation of Article 92, UCMJ. The commander imposed the following punishment: reduction to the grade of senior airman, and a reprimand.

A suspension is the postponement of the application of all or part of the punishment for a specific probationary period. The punishment will be automatically remitted at the end of that period, if the member does not violate the conditions of his or her suspension or any other article of the UCMJ.
