Officer charged with murder of son Published Nov. 23, 2005 88th Air Base Wing Public Affairs WRIGHT-PATTERSON AIR FORCE BASE, Ohio (AFMCNS) -- An Air Force officer was charged formally Nov. 21 in the death of his five-week-old son.Second Lt. David A. Valois, a program manager in the Human Resources Enterprise Business Systems with the Air Force Research Laboratory, was charged with murder under Article 118 of the Uniform Code of Military Justice.The next step in the military justice system is an Article 32 hearing, which has not yet been scheduled. Based on evidence presented at the hearing, the investigating officer will make a recommendation to the convening authority on whether the case should go to trial. The convening authority is Lt. Gen. John L. Hudson, commander, Aeronautical Systems Center.If tried and convicted of the preferred charge, the maximum sentence is confinement in prison for life without parole and dismissal from the Air Force.As in the civilian legal system, the accused is presumed innocent until proven guilty beyond a reasonable doubt.The infant, Andre Valois, was taken from base housing Oct. 2 to Children's Medical Center and died there.The accused was placed in pre-trial confinement on base Oct. 3. A pre-trial confinement hearing was held Oct. 12. At the hearing, a neutral and detached officer determined there was probable cause for Lieutenant Valois to remain in confinement until his trial.
